1. Introduction

Welcome to Mvision Web. These Terms and Conditions govern your use of our website and services. By using our website or engaging our services, you agree to these terms.

Mvision Web is a trading name of Msimanga Vision (Pty) Ltd, registered in South Africa.

2. Our Services

We provide web design, web development, website hosting, SEO, branding, and related digital services. Each project is governed by a separate service agreement or quote that outlines the specific scope, timeline, and pricing.

3. Quotes and Pricing

• All quotes are valid for 14 days from the date of issue unless otherwise stated
• Prices are quoted in South African Rand (ZAR)
• A 50% deposit is required before work commences on any project
• The remaining 50% is due upon project completion and before final delivery
• Hosting fees are billed monthly in advance

4. Client Responsibilities

• Provide accurate and complete information required for the project
• Provide feedback and approvals within agreed timelines
• Provide content (text, images, logos) in a timely manner
• Maintain backups of your own data
• Ensure you have the rights to all content you provide

5. Intellectual Property

What you own: Upon full payment, you own the final delivered website design and code (excluding third-party components like WordPress, plugins, stock images, and fonts which remain under their respective licenses).

What we own: We retain the right to display the work in our portfolio and marketing materials unless otherwise agreed.

6. Hosting Terms

• We provide hosting through our reseller plan. Uptime is targeted at 99.9% but not guaranteed
• We are not responsible for downtime caused by third-party providers, cyber attacks, or force majeure
• We perform regular backups but clients should maintain their own backups
• Hosting fees are non-refundable
• We reserve the right to suspend hosting for non-payment after 7 days notice

7. Revisions and Changes

Our standard packages include up to two rounds of revisions. Additional changes beyond scope may incur extra charges. Major scope changes after work has begun may require a new quote.

8. Cancellation and Refunds

• Clients may cancel at any time by written notice
• The deposit is non-refundable as it covers initial work and project setup
• For ongoing services (hosting, maintenance), cancellations take effect at the end of the current billing period
• We reserve the right to cancel a project if the client fails to provide required content or feedback for more than 30 days

9. Limitation of Liability

Mvision Web is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by the client for the specific service giving rise to the claim.

10. Website Use

• You may not use our website for any unlawful purpose
• You may not attempt to gain unauthorised access to our systems
• You may not reproduce, distribute, or modify our website content without permission

11. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be handled in the courts of Gauteng, South Africa.

12. Changes to Terms

We may update these terms at any time. Changes will be posted on this page. Continued use of our services after changes constitutes acceptance of the updated terms.
